Pre-Nuptial Agreements are not currently binding in England; that said, if they have been entered into sufficiently in advance of the marriage, both parties have received independent legal advice and there has been financial disclosure, they will be very persuasive to the court. The court will consider whether the terms are ‘fair’; even if they are found to be unfair, the fact that there was an agreement is likely to result in a financial outcome that is considerably lower than would have otherwise been the case.
