In essence, you can divorce in England if you both lived here prior to the separation and one of you is still living here, or if you have been living here for at least 12 months (reducing to six months if you are also domiciled here) prior to initiating divorce proceedings. The concepts of ‘habitual residence’ and ‘domicile’ are different to those used for tax purposes and focus more on your centre of interest and where you consider yourself to be from. As such a divorce can also take place here if both parties are domiciled here.
